Judgment

    IPP AJA : The appellant was charged with malicious wounding causing grievous bodily harm. After a committal hearing he was committed to stand trial. He appeals against the order made at the committal hearing. Thereafter, that is after the committal hearing, the appellant pleaded guilty in the District Court on a charge of causing actual bodily harm and was convicted and sentenced to 12 months imprisonment with a non-parole period of nine months.

    The appeal raised this morning is against the order made at the committal hearing committing him to trial.

    In the light of what has transpired since then, the point raised in the appeal is moot: that is to say it would be futile, in the light of subsequent events, to make any decision in that connection.

    For that reason I would dismiss the appeal.
