Delegation by Minister
(1) The Minister may, in writing, delegate any or all of the Minister’s functions or powers under an acquisitions provision to: (a) in any case—an SES employee or acting SES employee in the Department; or (b) in the case of the Minister’s power under subsection 51ABY(5) or 51ABZQ(5): (i) the Commission; or (ii) a member of the Commission; or (iii) a member of the staff of the Commission who is an SES employee or an acting SES employee. (2) Subsection (1) does not apply to the Minister’s power under subsection 51ABB(2), 51ABC(3), 51ABP(1), 51ABQ(1), 51ABRA(1), 51ABRB(1) or 51ABS(6). (3) The Minister may delegate a function or power to a person under subsection (1) only if the Minister is satisfied that the person has appropriate qualifications, training or experience to perform the function or exercise the power. (4) In performing a delegated function or exercising a delegated power, the delegate must comply with any written directions of the Minister.
