Relationship with other duties and obligations
A duty of confidence owed under an agreement or arrangement is of no effect to the extent that it is contrary to section 58BR or 58BS. Note: Each of sections 58BR and 58BS is also a requirement by law to disclose the information contained in the report referred to in that section. So, complying with that section can be a defence to a secrecy provision such as section 276 of the Telecommunications Act 1997 (see paragraph 280(1)(b) of that Act).
