Exemplary and aggravated damages
(1) A court must not, in a proceeding to which this Part applies, award exemplary damages or aggravated damages in respect of death or personal injury. (2) This section does not affect whether a court has power to award exemplary damages or aggravated damages: (a) otherwise than in respect of death or personal injury; or (b) in a proceeding other than a proceeding to which this Part applies.
