When the FWC may make an order in relation to an unfair contract term of a services contract
(1) The FWC may make an order under this Part in relation to a services contract if the FWC is satisfied that the services contract includes one or more unfair contract terms which, in an employment relationship, would relate to workplace relations matters. (2) The FWC may make the order only if a person has made an application under section 536ND in relation to the services contract. (3) The FWC must take into account fairness between the parties concerned in deciding whether to make an order under this Division, and the kind of order to make.
