Terminating employment because of payment flag etc.
A person must not terminate the employment of an employee on either of the following grounds: (a) a payment flag is operating in respect of a superannuation interest of the employee; (b) a superannuation agreement or splitting order is in force in respect of a superannuation interest of the employee. Penalty: 100 penalty units. Note: The penalty for a body corporate is 500 penalty units. See subsection 4B(3) of the Crimes Act 1914.
